If your company was headquarterd in MA you'd have different converage - unfortunately you are bound by the insurance laws in effect where your company is headquartered. MA has more health insurance mandates than any other state in the US - any chance of picking up MA based coverage? Is your partner employed by a MA based company? If so when is open enrollment for their insurance plan? It may be coming up soon. Otherwise your HR department should be able to get you information about petitioning, etc. The state department of insurance in the state where your company's insurance is written can fill you in on the state regulations/mandates with regard to coverage.

This is one of the sucky parts about mandated states: not everyone is covered. I have a friend who lives in MA but works for the federal government. The feds are exempt from all mandates.

I agree with petitioning your HR department. Perhaps with arguments about your company's competitors in MA and how they offer coverage.

I'd also talk to folks at your local RESOLVE and see if they have advice.

I'm sure you're not looking for another job but Talbot's (a fabulous MA based company) offers IVF coverage if you're part time B, which requires as little as 20 hours a week. Perhaps there's some thing you or your husband could do there?

I failed to mention in my first post that my husband has TWO part time jobs that offer him NO insurance but agree to work around his FT class schedule.

Getting into a nursing program is VERY competitive here. Scott was on a waiting list at a couple of schools before he got in.
We live in the city and have one car that I use for work. Talbots is in Hingham and Lakeville and there is no easy way to commute there with public transportation.
Guess we may both need to spend a lot of time (which neither of us have) researching other jobs.

I only started at FedEx in Sept but I thought FedEx, being a "progressive" company, would cover me.

Scott & I will have to learn somehow ahead of time about companies that cover as I can hardly imagine asking a lot of IVF questions during the interview! :) They would think I'd want to get pregnant right away and discriminate that way.

Getting another job is not as easy as it seems. Outside of the IVF thing, FedEx is a good fit for my career goals.

For me, getting another job in another industry could also mean a pay cut. And like it or not, until Scott finishes nursing school, I am Head of Household.

I chose Mass General Fertility/IVF clinic because they have some of the highest success rates in the country.

Their financial dept though, leaves little to be desired. They basically told me "SORRY" and that's that.

I called Boston IVF and, even though I am NOT a patient there, they were VERY GOOD about giving me other options/resources.

They partner with lenders to offer (high interest!)loans (which would be my LAST resort).

There's also "supplemental" insurance from Blue Cross/Blue Shield which averages about $500/mo including meds coverage PROVIDED I GET APPROVED. Even though we do not have an extra $500/mo lying around this would be a great option because it is obviously less expensive than paying for a few rounds of IVF directly.

Boston IVF also suggested appealing insurance decision. Or perhaps appealing to someone's common decency at Fedex to reach a compromise (pay for a round or two, or help pay for the supplemental insurance if I get approved).

I did call the Div. of Insurance who transferred me to the Dept. of Labor who transferred me back to Div. of Insurance. The state agencies were not overly helpful but said I could mail them a letter to file a public complaint.

I don't think that will get me many promotions though.

I was afraid to approach HR for the same reason but maybe if I do some sort of compromise could be met.

I am so frickin' overwhelmed.

Like I mentioned in my last post I am almost 40 now - by the time I sort through all the red tape for the best solution, Scott will probably graduate and have a job in a Boston hospital that covers IVF. By that time I'll be 41 & a half...

Any additional comments are still welcomed and appreciated.

I will let you know if I find out any other information during my journey that can be useful/helpful to others in the same boat.

Damn...does MA mandate IVF coverage? That is amazing even though some cheap companies obviously try to get around the coverage.

Yes, Mass Mandate is comprehensive - explicitly states it includes IVF, GIFT, etc etc.

My OB/GYN told me that if I found a company like FedEx that has commercial group insurance I could get the coverage my former employer denied (because they had self-funded insurance exempt for state rules).

I thought I solved the problem only to hit another wall.

Lucky as I am to live in Mass it is ridiculously hard to actually benefit from the legislation. The frustration is unbelievable.

The Mass. Div of Insurance is not even completely clear on whether or not out of state insurance needs to cover Massachusetts residents.

In MARYLAND, I found out, mandate is worded to cover ALL MD residents, even if their insurance is out of state.

I will be writing letters to Sen Kennedy and Gov elect Duvall Patrick about improving/clarifying the legislation.

If it doesn't help me :( at least it can help other women...

The only thing I am grateful for, is going through infertility in the age of the internet. So many of my family members and friends "don't get it" and having sites like these make me feel less alone...

This kind of thing just infuriates me. I've had 6 early miscarriages and yet, would not be considered infertile by most definitions. Inability to conceive or carry a pregnancy to term should both be classified as "infertility" and be a covered expense in all states.
